Terms of Service

1. Agreeing to these terms

SporeDesk is built and operated by Matthew Ahrens, an individual based in Tennessee, USA ("I," "me"). By creating an account or using SporeDesk, you agree to these Terms and to the Privacy Policy. If you don't agree, please don't use SporeDesk.

2. Who can use SporeDesk

• You must be at least 18 years old.
• Each account is for one person. Give accurate information when you sign up.
• You're responsible for keeping your password safe and for what happens in your account. Tell me right away if you think someone else has gotten into it.

3. The beta

SporeDesk is currently in a private beta. During the beta:

• It's free. I won't charge you anything for using SporeDesk during the beta.
• It's unfinished. Expect bugs, missing features, and changes, sometimes without notice. Features may be added, changed, or removed.
• Keep backups. I work hard to protect your data, but I can't guarantee it will never be lost. Keep your own records of anything you can't afford to lose.
• Feedback check-ins. Beta testers agree to complete three short feedback check-ins. On check-in days, the app may ask for the check-in before you continue, with a limited number of chances to postpone it.
• Beta codes are for you. Please don't post your beta code publicly.

If SporeDesk introduces paid plans after the beta, I'll tell you in advance. You'll never be charged without agreeing to it first.

4. Your content

Everything you put into SporeDesk (your records, notes, recipes, and photos) belongs to you. You give me permission to store, copy, process, and display it only as needed to run SporeDesk for you, including keeping backups. This permission ends when your content is deleted, apart from backups that expire on their normal schedule.

You're responsible for what you upload. Only upload content you have the right to use, and don't upload anything illegal or anything that infringes someone else's rights.

I don't review what you log unless you ask me for help, I'm investigating a bug, or I'm legally required to. See the Privacy Policy for details.

5. Feedback

If you send me feedback or suggestions, I can use them to improve SporeDesk without owing you anything for them. Thank you in advance, though. It's the whole point of the beta.

6. Using SporeDesk responsibly

You agree not to:

• use SporeDesk for anything illegal, or to plan or record illegal activity;
• try to access other people's accounts or data;
• try to break, overload, or get around SporeDesk's security or access limits;
• scrape, copy, or resell SporeDesk or its content, or use automated tools to access it without my permission;
• upload malware or anything designed to cause harm.

Following your local laws is your responsibility. Laws about what can be grown, possessed, or sold differ from place to place. You're responsible for making sure your cultivation, and your use of SporeDesk, comply with the laws where you live.

7. Information, not advice

SporeDesk's recipes, species information, calculators, and reference material are general information, provided as-is. They aren't professional, medical, or safety advice, and results aren't guaranteed. Growing conditions, equipment, and materials vary. You're responsible for your own grows, for using equipment like pressure cookers safely, and for anything you choose to eat, take, give away, or sell. Check with a qualified professional where it matters.

8. Legal requests for your data

I'll only disclose your data if legally required to, such as by a valid subpoena or court order. Where the law allows, I'll notify you before doing so.

9. Ending your use of SporeDesk

• You can stop using SporeDesk at any time and ask me to delete your account, as described in the Privacy Policy.
• I can suspend or close an account that breaks these Terms, or when needed to protect SporeDesk or other users. Where it's reasonable, I'll tell you why and give you a chance to get a copy of your data first.
• I may also end the beta or shut SporeDesk down. If that happens, I'll give reasonable notice so you can get a copy of your data.

10. SporeDesk itself

The SporeDesk name, app, website, design, and built-in content belong to me. These Terms let you use SporeDesk. They don't give you ownership of any part of it.

11. No guarantees

SporeDesk is provided "as is" and "as available." To the fullest extent the law allows, I make no promises that it will be uninterrupted, error-free, secure, or fit for any particular purpose, or that anything in it is accurate or complete.

12. Limits on liability

To the fullest extent the law allows, I'm not liable for indirect or consequential losses arising from your use of SporeDesk, including lost data, lost or contaminated grows, lost profits, or damage to property. My total liability to you for any claim related to SporeDesk is limited to the greater of what you paid me for SporeDesk in the 12 months before the claim, or $50.

If someone makes a claim against me because of how you used SporeDesk, or because you broke these Terms or the law, you agree to cover the reasonable costs of that claim.

Some places don't allow some of these limits. Where that's the case, they apply only as far as the law allows.

13. The legal details

These Terms are governed by the laws of the State of Tennessee, USA. Any dispute will be handled in the state or federal courts located in Tennessee. If any part of these Terms turns out to be unenforceable, the rest still applies. These Terms and the Privacy Policy are the whole agreement between you and me about SporeDesk.

14. Changes to these terms

I may update these Terms as SporeDesk changes. I'll update the date at the top, and for significant changes I'll let users know by email or in the app before they take effect. Continuing to use SporeDesk after that means you accept the updated Terms.
